A little background;

PK Aviation commenced in January 2007 to provide a single point of contact for Aircraft Maintenance Organizations to source permanent or independent contract workers of all trades and support roles associated with aircraft maintenance.

Rather than being just another place to look for people, PK Aviation strives to become a business associate to work with our customers to meet their recruiting needs.

 

NEED PERMANENT STAFF?

When searching for staff to fill a vacancy, visit our download page on http://www.pkaviation.com.au/ and obtain a Personnel Request Form. Simply complete and return via e-mail for each position you need to fill.

PK Aviation will then provide the following support;

1. When the form is received, advertising is updated on locations such as http://www.seek.com.au/ and http://www.careerone.com.au/, as well as PK Aviations own website. Advertising can be placed in other locations including sites that focus on overseas locations if you desire. Extra charges may apply for overseas advertising.

2. New applicants are reviewed for their suitability and our existing database is also reviewed for any suitable candidates. PK Aviation vets apparent suitable candidates with structured questions to gauge their basic CV claims and attitude towards the industry.

3. Prospective candidates are then presented for your review. If approved, interviews are arranged. PK Aviation can assist in arranging an interview. Unless agreed, PK Aviation is not responsible for any costs associated with the recruiting, interview or relocation process of the candidate.

Up to this point, you pay nothing to PK Aviation. Actions listed above are free of charge to our customers.

4. Should the candidate be successful in securing a position, you are invoiced in accordance with Schedule A of our pricing structure. 

 

OTHER SERVICES AVAILABLE

PK Aviation is able to assist further by supporting you in the recruiting process by;

1. Exclusive recruiting service, where you source all your external recruiting actions through PK Aviation. This attracts extreme discounts on our flat-rate fees and your company logo is proudly displayed (subject to your approval) on all our advertising,

2. Perform initial telephone interview on your behalf. Using structure questions to further investigate the suitability of the candidate, you will receive a recording of the interview as well as a written report summarising answers to each question and providing an opinion on the candidates suitability,

3. Arrange flights, accommodation and other required support to the interview process,

4. Perform “Recruiting Road Shows” where PK Aviation visits key locations and take your company to the candidates.

5. If you have any other needs, simply call or send an email and ask.

Tasks listed in “OTHER SERVICES AVAILABLE” are not included in the basic Schedule A of PK Aviation pricing structure and will be charged on a case-by-case basis.

SOMETHING TO PONDER!!!

Some times it is easier to start prospective employees as an independent contractor. This way there is a defined period. Contract finished - Contract finished. The cost of engaging someone as an independent contractor can be used as a “Trial Period” which is simpler than probation periods. The individual may work out to be perfect for that short-term project but just not exactly what you are looking for a permanent employee.

 

NEED INDEPENDENT CONTRACTORS?

We all know the aviation industry is Feast or Famine, particularly within the maintenance realm. When peaks arise in your schedule, short term Independent Contractors may be the answer to help you ride the wave.

You can obtain support by performing the following steps;

Prospective candidates are presented for your review and approval. When you are satisfied with an individual for a position, your company and the independent contractor sign an agreement with each other. PK Aviation can provide a standard contract for use between the Independent Contractor and the Aircraft Maintenance Organization. This is a generic contract reviewed by PK Aviation lawyers to cover standard arrangements used in the aviation industry. We have added some extra clauses, which will be of interest. These clauses or others may be added or removed as required by either party. You may wish to obtain independent advise before using this or any other agreement.

5. When PK Aviation confirms the signed contract, the independent contractor is dispatched and commences work.

Up to this point, you pay nothing to PK Aviation. Actions listed above are free of charge to our customers.

6. Once the independent contractor commences work, you are invoiced in accordance with Schedule B or C of our pricing structure. 

POINTS OF INTEREST WITH A PK AVIATION AGREEMENT

MINIMUM HIRE TIMES

There is a Minimum Hire Time established within the agreement. Things change daily in aviation and it can be difficult to forecast how long you will need extra personnel. At times, independent contractors will travel vast distances away from home and depending on their agreement with you, may outlay funds for accommodation and travel. Knowing that they will be employed for a MINIMUM TIME, contractors will be more willing to travel away from their home base to support your operation.

As an example, if you think you need a contractor for 1 or 2 months, a good MINIMUM TIME would be 1 month. This way the contractor knows he will be employed for a minimum of 1 month.

ASSESSMENT PERIOD

There is a 1-week assessment period within the agreement where you are able to release an un-suitable contractor and waive the minimum hire time in the agreement. The performance of independent contractors sourced through PK Aviation reflects directly upon our company and we will not tolerate inadequate performance or standards. Our number 1 goal is to ensure your needs are met with efficient personnel support. Whilst all endeavours are made to verify a contractors CV claims, many times we do not personally met the individuals who arrive at your facility. If YOU are not happy with an individual, then he may not be suitable for other PK Aviation customers.

 

FEES AND CHARGES

We operate a little different to what you are probably used to. The aim is to make the acquisition of independent contracts or permanent staff easy and cost effective for you. Here are some interesting points.

1. Our FLAT FEE system allows you to easily budget for your personnel needs.

2. Our fees are structured on the experience level of the individual. 

INDEPENDENT CONTRACTORS

An independent contractor from PK Aviation is easy and our system removes the guesswork from budgeting for extra personnel.

Your agreement with the independent contractor is a flat rate paid by you directly to the worker who, as an independent contractor, is responsible for his or her own Tax, Super and Work Cover. You do not have to worry about payroll or superannuation costs. You can pay your contractor, weekly, fortnightly or monthly as agreed with your contractor.

There are other charges that may be applicable. Accommodation, Meals, Hire cars or Travel charges are totally up to your discretion. Obviously, if local independent contractors are not available, to attract independent contractors from other areas, these add-ons may come into play.

PK Aviation offers a template to simplify and document the agreement between you and the contractor and has been written by our lawyers to best meet Federal Independent Contractor Legislation. You may wish to seek your own legal advice to review any completed document. 

In addition to the agreed flat rate you will pay your independent contractor, we charge a simple flat rate fee per week, or part thereof, the independent contractor is on site, including initial and terminating travel time. This fee is based upon the experience and qualifications of the individual. An apprentice will not cost as much as a LAME with 20yrs experience. Moreover, our sliding scale means that the longer the contractor is on site, the less the fees are.

PERMANENT

PK Aviation does not have % fees for assisting to place permanent workers. Our flat placement fees are based on the experience of the individual you are employing.

FREQUENTLY ASKED QUESTIONS

IS PK AVIATION A LABOUR HIRE FIRM?

PK Aviation is not a Labour Hire Organization.

The Australian Taxation Office (ATO) describes a Labour Hire Organization as;
“Labour hire arrangements commonly involve at least two contracts. A user of labour (the client) typically contracts with a labour hire firm for the provision of labour of a specified kind. The labour hire firm does not contract to perform the work; it merely contracts with the worker and pays the worker. The worker is not an employee of the client and there is no contract between the worker and the client. The worker may or may not be an employee of the labour hire firm.”

The triangular relationship is described below;

PK Aviation provides recruitment for Permanent Staff and a referral service for Independent Contractors. Maintenance Organizations sign an agreement with PK Aviation to source both prospective permanent employees and when needed, independent contractors. For this service, PK Aviation receives a placement or referral fee.

WHAT OTHER POINTS RELATE TO LABOUR HIRE FIRMS?

The ATO may consider the Contracted Worker as an employee and as such, the ATO has the following opinions;

Withholding tax from payments;

If you make a payment of salary or wages to an employee, you will be required to withhold anamount from that payment and send the amount to the Tax Office. Section 12-35, Part 2-5, Schedule 1 Taxation Administration Act 1953

Use of an ABN by a worker employed by a Labour Hire Firm;

ABN:Activities done by a person as an employee are excluded from the definition of enterprise andtherefore an employee is not entitled to have an ABN in respect of those activities. Section 38(2)(a) A New Tax System (Australian Business Number) Act 1999

Charging GST;

GST: There will not be any GST on this payment because an employee is excluded from the definition ofenterprise as such and would not be entitled to register for GST purposes. Sections 9-20(2)(a) and 9-20(4) A New Tax System (Goods and Services Tax) Act 1999

NOTES: The information described above relates to the opinion of the ATO as viewed on their website on the 22 July 2007 and may be viewed different by other departments of government.

This means that if the worker is considered to be an employee, which is very difficult to determine using the guidelines provided, the Labour Hire firm is required to withhold tax from workers payments. Furthermore, should the worker have an ABN, the worker is unable to use their ABN. Likewise, if the worker is registered for GST, he/she is not permitted to add this charge.

PK Aviation decided to restructure away from the Labour Hire Service for a number of reasons, one of which was so that the contract workers we refer will be able to utilize their freedom to operate as a true Independent Contractor.

 

SUMMARY

INDEPENDENT CONTRACTORS

PK Aviation continues to build and amend its database of quality LAMEs and AMEs who wish to perform regular contract work. We also keep a list of workers who we consider are not suitable for representation by PK Aviation. These individuals may have broken contracts early for no reasonable exceuse, performed inadequately either professionally or socially whilst on contract.

In the future it is hoped that PK Aviation will be able to have a pool of quality, dedicated engineers to refer to customers who keep coming back. We would hope that you would consider PK Aviation as a business partner, not just somewhere to go when you need maintenance support.

PERMANENT CANDIDATES

PK Aviation provides you with basic recruiting services where you ask for candidates, we review all current and newly received applicants for suitability and present CVs of the most suitable for your review. Providing you have a current agreement with PK Aviation, we help you arrange either a phone interview but are willing and able to perform more. 

Optional services include;
