2. Provide a service where Independent Contractors can view available positions from Aircraft Maintenance Organizations who need short or long term Independent Contract workers and negotiate the best rate possible for for the contractor.


PERMANENT JOB SEEKERS  
  
For jobseekers who are looking for a permanent position, PK Aviation will act on your behalf with the goal of obtaining you an interview for the vacant position.   Should you be offered an interview, your future employment with the employer is totally up to you.   Following successful recruitment, the jobseeker will become a fulltime employee of the company seeking the worker.

Often, PK Aviation will not know all the details of the position, including the salary.   Some employers do not provide this and other information for various reasons.   Normally this information will be provided during the interview process.

PK Aviation does not charge the Job Seeker for this service and receives a once only flat fee payment from the employer only when a worker commences full-time employment.   There is no further relationship between party once the employee commences work.  



CONTRACT JOB SEEKERS
 
Our job is to help you exercise your expertise and qualifications within the aviation industry.   We all know the aviation industry is Feast or Famine, particularly within the maintenance realm.   We will do our best to keep you employed.

PK Aviation is doing the leg work for you with Maintenance MRO’s and operators to get you well paid contracts.   We hope to have you gainfully employed for as long as you wish.   That’s the point, YOU are your own boss.   You may accept or decline work as you require.

PK Aviation has a standard contract for use between the Aircraft Maintenance Organization and the Contractor.   This contract is free to use for contractors obtaining a referred position through PK Aviation.   You may wish to seek independent legal advise before using this or any other contract.

PK Aviation receives a flat fee for each week the contractor is on site.


 

FREQUENTLY ASKED QUESTIONS

What is a contractor?

Various regulatory bodies within Australia may have different rules and regulations regarding who is a contractor and who is an emlpoyee.   You may wish to seek independent professional advise depending on your personal situation.

Generally, within the aviation industry, Individuals who wish to select short or long term contracts usually choose to move from job to job as they become available.   These individuals usually have already set up for an ABN and get the benefit's of being in their own business, much like building labourers who work for many different building companies.     These people are typically referred to as Contractors as they work for a contracted period then move on to another location and another contract.
   
They have the flexibility to choose their own work schedule and to accept or decline work as they see fit.   Contractors are normally paid a Flat Rate for providing their services and are not normally paid for overtime, public holidays or holiday time.   Contractors are also responsible for their own superannuation, income taxation and other responsibilities such as work cover or even professional indemnity insurance.

One of the drawbacks is that contractors normally do not get paid on their time off.   Contractors may accept a job sourced by PK Aviation then may accept a job sourced by another recruiting company and then may accept a job through yet another.   So in fact the contractor is essentially his own boss.

Do I need an Australian Business Number (ABN)?

When PK Aviation first started, we were set up like other recruiting companies who the ATO refer to as a Labour Hire Firms (LHF) and as such the ATO does consider the worker hired to perform work and paid by a LHF, an employee of that LHF.   As per the ATO laws, the LHF is responsible for with-holding tax for salary, pay the worker superannuation, cover each person for work-cover and other such rules.   Moreover, the ATO also has decreed that should any person obtain work through a LHF, the worker (contractor) is not able to obtain the benefits associated with holding an ABN.   This can upset the continuity of a worker (contractor) as he may already have a business set up and then, effectively doesnt.   You may wish to seek independent the services of an accounting or taxation specialist for more details.

As a contractor may accept a job with one particular LHF for a 1 month contract and then may never accept work through this LHF again, it is difficult to see how the contractor can be considered an employee of the LHF as the LHF cannot control when the contractor works or even if the contractor even comes back to accept more work.

PK Aviation does not consider this in the best interest of the contract worker and therefore has spent considerable time and funds to restructure the business for a multitude of reasons.   Primarily the restructure was to allow workers who choose to be contractors the ability to use their ABN legally.

Summing up, if you wish to just be an employee and apply for a permanent position advertised by PK Aviation, then an ABN is not required.   Should you wish to perform short or long term contract work, then an ABN is required.
